Applicable Law, Customer Position, and Contract Content

This contract solely concerns the rental of a camper van with custom interior equipment and, where applicable, accessories, by Gesibris SL (Wheely Fog) as the lessor to the lessee. This contract is governed by Spanish law. To resolve disputes related to the interpretation or execution of the contract, both parties submit to the Courts and Tribunals of Valencia, expressly waiving any other jurisdiction that may apply.

The lessee uses the vehicle under their responsibility. The vehicle may only be driven and used for travel in the following countries (“Permitted Countries”): European Union member states, as well as Iceland, Norway, Switzerland, Albania, Andorra, Bosnia and Herzegovina, Moldova, North Macedonia, Montenegro, Serbia, and the United Kingdom. Travel to or driving in Azerbaijan, Belarus, Israel, Iran, Morocco, Russia, Tunisia, Turkey, Ukraine, and all other non-EU countries is strictly prohibited unless explicitly permitted within the listed Permitted Countries.

Camper vans may only be used for private purposes, such as vacation travel, sports events, and daily use. Commercial use, unusual road behavior, or use for moving purposes is prohibited. Non-compliance entitles Gesibris SL (Wheely Fog) to terminate the contract without prior notice for justified cause, subject to possible claims for damages.

The lessee is prohibited from using the rented vehicle to participate in motor sports events and vehicle tests or to transport hazardous materials. The vehicle may not be used for customs offenses, other criminal activities, subletting, lending, unauthorized commercial purposes, or non-contractual uses. In case of doubt about the intended use of the rented vehicle, Gesibris SL (Wheely Fog) reserves the right not to hand it over.

Authorized Drivers

The lessee certifies that they are at least 21 or 25 years old, depending on the type of vehicle rented, and that they hold a valid category B driving license for at least two years.

The lessee and all drivers must be registered in writing in the rental contract and must present the original driving license to the lessor when receiving the vehicle. Copies will not be accepted. The lessee is responsible for the vehicle during the agreed rental period.

The lessee must assume responsibility for the driver’s actions as if they were their own.

All persons traveling with the lessee during the rental period must be named to the owner. If there is any doubt about the declared travel purpose or the number of travel companions, the lessor reserves the right not to deliver the rental vehicle.

The rented vehicle may only be driven by the lessee and the drivers specified in the rental contract. Allowing an unauthorized driver to operate the rental vehicle is considered a violation of the rental conditions. The lessee is responsible for all damages caused by an unauthorized driver. The unauthorized driver is not covered by any insurance provided by the rental company (coverage packages, etc.). Coverage in these cases is exclusively limited to statutory liability insurance.

The lessee or drivers are not authorized to operate the rented vehicle if their driving ability is impaired, especially due to alcohol, drugs, or illness. The lessee is not authorized to disassemble or modify vehicle components, particularly traction, brake, steering, and/or bodywork elements, or to disable telematics systems without the prior written consent of the lessor. In the event of culpable violation, the lessor has the right to extraordinary termination.

Pricing

The total rental price consists of the daily rental rate and, if applicable, any contracted accessories. The daily price also includes the rental of the vehicle for the period specified in the rental contract. It also covers maintenance costs and the repair of parts worn out through use, as well as comprehensive insurance coverage with a €600 deductible. The prices published at https://wheelyfog.com/temporadas-y-tarifas/ at the time of contract execution include the applicable VAT rate. The daily rental prices can be found in the Wheely Fog pricing list at https://wheelyfog.com/temporadas-y-tarifas/.

The total rental amount must be paid in full upon reservation if made less than one month before the trip start date. If the reservation is made more than one month in advance, 30% of the total amount may be paid to confirm the booking, with the remaining 70% due one month before departure. Additionally, a variable deposit is required depending on the selected insurance plan to ensure proper use and return of the vehicle, payable via a bank card. In the event of an incident during the rental contract, the client will bear the costs, which may be deducted from the deposit. If the vehicle is refueled with incorrect fuel, the full repair cost will be charged, even if it exceeds the deductible amount. The deposit will be refunded after the vehicle is inspected by the lessor, who will determine any misuse-related damages and deduct any necessary repair costs from the deposit. If immediate damage assessment is not possible, the lessor has 30 days to return the remaining deposit after deducting repair costs.

All additional costs not explicitly included in the total rental price are the lessee’s responsibility. These include tolls, fuel, parking fees, campsite fees, and other parking or transport-related costs, such as ferry expenses. In some cases, a previous lessee may have covered vehicle expenses (e.g., an annual Swiss vignette), which the current lessee may continue to benefit from. However, the current lessee cannot demand these additional services. Any fines or penalties incurred will be the lessee’s responsibility. In certain cases, the lessor may receive invoices for fines or fees and will process the payment, recovering the amount from the lessee. Otherwise, the relevant authorities may directly contact the lessee for payment.

The rental contract includes an allowance of 100 kilometers per day. If a higher limit is needed, the lessee can purchase additional mileage packages at an extra cost. If the mileage limit is exceeded, an extra fee of €0.25 per km will apply. The Comfort coverage option increases the mileage limit from 100 km to 200 km per day, while the Extra coverage option grants unlimited mileage during the rental period.

As a general rule, special discounts (promotions, employee offers, or fair promotions) cannot be combined with other discounts such as long-term rental discounts or early booking discounts.

Reservations

By submitting the completed reservation form, the lessee makes a binding offer to formalize the rental contract and acknowledges the general conditions of the contract with Gesibris SL (Wheely Fog) through an “opt-in” process during the reservation procedure.

For informational purposes, the lessee will receive a message on the reservation page and an automatic direct email from Gesibris SL (Wheely Fog) confirming the receipt of the reservation request. The rental reservation will be binding for the lessee (i.e., the contract is concluded), and the vehicle will be considered reserved only after the lessee receives written confirmation, actively sent by Gesibris SL (Wheely Fog), after paying the total rental amount or the required deposit as applicable.

Gesibris SL reserves the right, within its discretion, to refuse to formalize a rental contract.

Cancellation

If the lessee cancels their binding reservation, the contractual right of withdrawal will apply as follows, depending on when the lessor receives the withdrawal notification:

  • Between 0 and 10 days before the agreed rental period start date, the full rental price, including extras, must be paid to Wheely Fog.
  • Between 10 and 15 days before the agreed rental period start date, a 50% refund of the total rental price, including extras, will be provided.
  • Between 15 and 20 days before the agreed rental period start date, a 70% refund of the total rental price, including extras, will apply.
  • More than 20 days before the agreed rental period start date, a full refund of the rental price, including extras, will be offered.

If the lessee ends the rental contract early by returning the vehicle, they will not be entitled to a partial refund of the rental price, a cancellation voucher, or a (partial) reservation change for other dates.

Payment Method and Deposit

Rental payments can be made conveniently through various methods. Wheely Fog offers flexibility for payments via bank transfer, cash, or credit card. These payment methods can be securely and easily managed through our online reservation portal at https://reservas.wheelyfog.com

Upon collecting the vehicle, a deposit is required, with the amount varying based on the selected insurance, payable via a bank card, to ensure proper use and return of the vehicle. In the event of an incident during the rental period, the client accepts responsibility for the corresponding amount, up to the maximum deductible, and expressly authorizes compensation of this amount with the deposited security deposit. If the vehicle is refueled with incorrect fuel, the client agrees to cover the total cost of repairs, even if it exceeds the established deductible amount.

The deposit will be refunded after the vehicle has been inspected by the lessor. If any damages due to misuse are identified, the lessor will determine the amount the client must pay through a detailed report, authorizing the client to compensate the amount with the deposited security deposit.

In cases where damage assessment cannot be performed immediately, the lessor has up to 30 days to refund the remaining deposit amount after deducting the cost of repairing damages or wear caused.

Rental Period

The rental period extends from the agreed vehicle pickup time to the final return. The minimum rental period varies by season: 2 days in low season, 3 days in mid-season, 4 days in high season, and 7 days in August. These minimum days may vary depending on availability.

The vehicle must be returned before the time specified in the rental contract. Any delay in returning the vehicle, except for force majeure, entitles the lessor to charge the lessee the equivalent of one day’s rental price for the vehicle.

Even if the vehicle is returned before the agreed delivery date, the total rental price stated in the contract must still be paid.

As a general rule, the lessor does not automatically extend the rental contract into an indefinite rental period.

Pickup and Return of the Rental Vehicle

Camper van handovers will take place at Wheely Fog’s facilities. The lessee must collect the vehicle at the location and time agreed upon in the rental contract. Pickup hours are from 9:00 AM to 7:00 PM, Monday through Saturday.

If you wish to pick up the camper outside of these hours, it will be subject to availability and an additional cost. Saturday afternoon, Sunday, and holiday pickups will incur an extra fee of €36.

At the end of the rental period, the lessee is required to return the vehicle at the location and time specified in the rental contract, along with all documents, parts, accessories, and equipment unless otherwise agreed in the contract. The camper must be returned between 9:00 AM and 12:00 PM on the agreed return date. If you wish to return the camper in the afternoon (after 12:00 PM), you must select an additional rental day. If the rented vehicle is not returned on the agreed date and the lessee does not immediately notify the lessor of the reason for the late return, the lessor will assume that the lessee is using the vehicle illegally. The lessor then has the right to file a report with the relevant authorities.

When returning the camper, the lessee must inform the lessor of any damages that occurred during the rental period. If damage is detected, the lessor will assess the costs within 30 days of return. If the inspection does not reveal hidden damages (e.g., due to exterior dirt), the return of the vehicle without any remarks does not constitute a negative acknowledgment of debt by the lessor.

The rental vehicle must be returned with a full fuel tank. If the tank is not completely full upon return, the lessee must pay for the refueling cost plus a penalty of €50. The lessor will deduct the refueling cost and penalty directly from the security deposit. Please note that this additional €50 penalty will apply in all cases where the vehicle is returned without a full tank.

Before returning the vehicle to the lessor, the following must be completed:

  • Interior cleaning (vacuuming and surface cleaning) (“Interior Cleaning”).
  • Removal of any significant stains or dirt from the exterior (e.g., excessive mud or grime).
  • Emptying of the fixed and/or portable toilet, as well as the potable and wastewater tanks (“Emptying”). The lessor will handle internal and external cleaning beyond these requirements.

Failure to comply will result in the following penalties:

  • No interior cleaning: €50.
  • Stains on upholstery: €40.
  • Tobacco odor: €100.
  • (For pets) Inadequate cleaning due to pet presence (e.g., fur or odors): €100.
  • Unclean toilet: €50.
  • Using the water tank with other liquids or fuel: €600.
  • Lost keys or vehicle documents: €150.
  • If incorrect fuel is used when refueling, the total repair cost will be charged, even if it exceeds the deductible amount.

Vehicle Conditions and Handover

Wheely Fog certifies that the VEHICLE is in good general condition, fully operational, and free from defects. This has been verified by the lessee in person. Additionally, the lessee is provided with valid documentation, including the registration certificate, up-to-date technical inspection report (ITV), and insurance. The lessee must return these documents to the lessor in perfect condition upon contract completion.

The VEHICLE is equipped with a built-in GPS tracker for security and crime prevention purposes.

The VEHICLE is delivered with a full fuel tank on the agreed pickup date.

The VEHICLE is covered by comprehensive insurance with a variable deductible, depending on the selected insurance plan. The conditions and extent of this coverage can be provided to the lessee upon request.

General Restrictions on Use

The lessee may not assign, sell, mortgage, pledge, or otherwise dispose of the VEHICLE, its documents, parts, accessories, or equipment. The VEHICLE may not be used in any way that could compromise the lessor’s ownership rights or any other rights the lessor may have over it.

Lessee Obligations

The lessee must take appropriate measures to protect and safeguard the VEHICLE, including, but not limited to, keeping it locked and ensuring that the GPS tracker remains activated.

The lessee may not carry out or authorize repairs on the VEHICLE. In case of a breakdown, the lessee must contact the lessor for further instructions.

The lessee is the only authorized driver of the VEHICLE unless expressly stated otherwise.

Additionally, the VEHICLE may not be used for:

a) Transporting passengers or goods for commercial or industrial purposes, or for any form of subletting, whether explicit or implied. b) Towing or pushing another vehicle or trailer. c) Sports events, training sessions, or endurance tests for materials, accessories, or products. d) Violating customs regulations or any other applicable laws, regulations, or ordinances. e) By individuals under the influence of alcohol or drugs. f) By individuals under the influence of medications or substances that impair normal driving ability. g) By unauthorized individuals.

Lessor’s Obligations

The Lessor is obligated to deliver the VEHICLE in good general condition, in perfect working order, and free of apparent defects; to carry out all necessary repairs so that the Lessee can use the VEHICLE normally; and to ensure the peaceful use of the VEHICLE by the Lessee for the entire duration of the Contract.

Lessee’s Responsibility

If not covered by the Insurance Policy referred to in this contract, in the event of theft or loss of the VEHICLE, or damages caused to the VEHICLE and/or third parties, whether arising from a civil or criminal offense, during the term of the Contract, the Lessee must pay the Lessor, as soon as requested, for all damages suffered by the Lessor, including but not limited to repair costs, depreciation, loss of rental income, and towing and storage expenses.

The Lessee is not only responsible for any damages suffered by the VEHICLE or caused to third parties but is also fully responsible for damages resulting from placing objects that protrude from or hang on the VEHICLE.

The Lessee releases the Lessor from any liability for loss or damage to objects left, stored, or transported by the Lessee or any other person, inside or on the VEHICLE, whether before, during, or after the rental period. The Lessee agrees to defend and indemnify the Lessor against any claims related to such cases.

Lessor’s Liability

The Lessor is responsible for damages suffered by the Lessee if they arise due to the Lessor’s negligence, except as stated in the following subsection.

The Lessor is not responsible for mechanical failures or breakdowns of the VEHICLE or any damages resulting from such failures or breakdowns, nor for expenses, delays, or inconveniences caused directly or indirectly by such failures, provided that the Lessor has taken due precautions and all necessary measures to prevent such occurrences.

Accidents and Damages

In case of a breakdown or malfunction of the rented vehicle (e.g., engine warning light activation or a flat tire), the Lessee must immediately contact the rental company’s hotline or the mobility guarantee service for instructions on the next steps.

The Lessee is required to report in writing and immediately to GESIBRIS SL (Wheely Fog) any defect affecting the vehicle during the rental period, providing all relevant details about the incident. The accident report must include, in particular, the names and addresses of the individuals involved, potential witnesses, as well as the license plates and insurance details of the affected vehicles. For this purpose, the Lessee must carefully and accurately complete all sections of the accident report form, available in the vehicle’s document compartment or upon request via phone or the GESIBRIS SL (Wheely Fog) website. The completed form must be sent immediately via email to info@wheelyfog.com.

Failure to comply with this obligation allows GESIBRIS SL (Wheely Fog) to impose a penalty of €1,000 on the Lessee, in addition to possible liabilities under Clause 14.

In case of an accident, fire, theft, animal-related damage, or other damages, the Lessee must immediately notify the local police, even in cases where they are solely responsible and no third party is involved. Failure to report the incident to the police results in the Lessee being fully responsible for any financial consequences for GESIBRIS SL (Wheely Fog), and third-party claims will not be accepted.

Except for the standardized European accident report, the Lessee is not permitted to sign any other document related to the accident.

If damages are detected during the trip, the Lessee must immediately inform GESIBRIS SL (Wheely Fog) via email. If a repair is required, the rental vehicle must be parked immediately to avoid further damage, and continuing the trip, even to the nearest repair shop, is only permitted with prior consent from GESIBRIS SL (Wheely Fog), unless the nature of the damage makes further damage unlikely.

If the Lessee takes the rental vehicle to a repair shop or has it towed to one, they must immediately inform GESIBRIS SL (Wheely Fog) during business hours and before authorizing any repair, providing details about the shop, estimated repair duration, and repair costs. Approval for the repair must be obtained before proceeding. GESIBRIS SL (Wheely Fog) will only cover the repair costs if the repair was previously approved and the corresponding receipts are provided. The exact contact details of the repair shop must also be reported immediately to GESIBRIS SL (Wheely Fog).

Insurance

The Lessee, as well as any Authorized Driver, are insured under the benefits of an Insurance Policy, with the following available options:

Basic Coverage:

  • Comprehensive insurance.
  • 24-hour roadside assistance.
  • Breakdown protection throughout Europe.
  • Deductible of €1,000.
  • Security deposit of €1,000.
  • Limited to 1 driver.
  • Included mileage: 100 km per night.
  • Exclusions: Repair and replacement of tires, repair and replacement of windows and windshield, interior and exterior damages, damages to the high and low areas of the vehicle, awning damages, damages due to improper use.

Comfort Coverage:

  • Comprehensive insurance.
  • 24-hour roadside assistance.
  • Breakdown protection throughout Europe.
  • Deductible of €600.
  • Security deposit of €600.
  • Limited to 2 drivers.
  • Included mileage: 200 km per night.
  • Included: Tire repairs, window and windshield repairs, interior damages, and damages to accessories.
  • Exclusions: Tire replacement, window and windshield replacement, exterior damages, damages to the high and low areas of the vehicle, awning damages, damages due to improper use.

Extra Coverage:

  • Comprehensive insurance.
  • 24-hour roadside assistance.
  • Breakdown protection throughout Europe.
  • Deductible of €300.
  • Security deposit of €300.
  • Unlimited drivers.
  • Unlimited mileage.
  • Included: Repair and replacement of tires, repair and replacement of windows and windshield, interior damages, damages to accessories, minor surface scratches (not affecting the vehicle’s bodywork).
  • Exclusions: Exterior damages, damages to the high and low areas of the vehicle, awning damages, damages due to improper use.

The Lessee accepts the terms and conditions of the selected Automobile Insurance Policy and agrees to comply with and observe the obligations imposed therein. Damages will be covered by the insurance provider as long as they exceed the established deductible. The driver must pay the repair costs excluded from the chosen insurance up to the deductible amount.

Applicable Law and Jurisdiction

This Contract shall be governed by Spanish law. For the resolution of any disputes that may arise regarding the interpretation or execution of this Contract, the parties, expressly waiving any other jurisdiction that may apply, submit to the Courts and Tribunals of Valencia.
